To make sure that you know what we do for you and what we require from you we have to cover the Terms & Conditions.

A word about Ontario's Travel Industry Act

Probably the best consumer protection laws in North America. We are registered under the Travel Industry Act. This effectively guarantees that any consumer who buys travel arrangements from a registered Ontario travel agent is protected against financial loss. General conditions & responsibilities applying to our escorted tours and custom holidays

What the tour cost includes:

Details for the services provided in each programme are specified in the information for the specific programme.

Cancellation Fees

Fees for cancellation by individual passengers are indicated in the information for the specific programme. If, for any reason, the tour should be cancelled by the operator, then their liability shall be limited to the refund of deposits and payments received.

What the tour cost does not include:

Passport and visa fees; meals and beverages other than those specified; personal items (laundry, bar bills etc); travel insurance premiums; any other item not specified in the specific tour information.

Singles and Sharing

Single room supplements are generally expensive, as the cost provides, in most cases, a double room for single occupancy. If you wish to share a twin-bedded room, we will do our best to find a suitable room-mate for you, but cannot guarantee this. In the event that one cannot be found, the single supplement will apply.

Good Health

Some locations present difficulties for people with disabilities or medical problems; we must ask that you advise us of these limitations before booking so that we can determine how best to accommodate your needs.

Passports & Visas

As a general rule, passports should be valid for 6 months after the end of your chosen holiday. Visa requirements vary from tour to tour; details will be give to you about 3 months before departure, together with appropriate forms, instructions, etc. As a general rule, we do not obtain visas for passengers.

Baggage

Baggage regulations vary with the airline and the route; details of applicable rules will be provided along with your packing tips, well before departure. Please note that generally we allow for one bag per person (maximum 44 lbs/20kg weight) on all coach holidays.

Itinerary and Final Documents

An outline day-by-day itinerary will be sent at time of booking. Final documents will include ticket wallet, baggage tags, detailed itinerary, mailing address/passenger contact sheets to be left with friends and relatives, air tickets where appropriate, etc.

Refunds for Unused Services

Such refunds are only available when (a) arrangements have been made in advance, AND (b) a participant misses more than 72 hours of a programme.

Changes

Once airline reservations have been made on your behalf, changes may incur an airline-imposed change fee which will be added to your final invoice; we may charge an administration fee of C$100 per change.

The Financial Arrangements

Details of deposit and final payment schedules are shown for each tour, as are details concerning cancellation. In all cases payments for travel and/or insurance coverage will be made to a registrant under the Ontario Travel Industry Act 1974 as amended. For all our holidays these payments will be to our parent company - The Travel Broker & Cruise Centre. The coverage of the Ontario Travel Industry Act extends therefore to arrangements made by JB&A Custom Holidays on your behalf.

Price Guarantee

The prices quoted are our best estimate of the costs for the holiday at the time of publication, which is usually 9 to 15 months before departure. About 10 weeks before departure, when we calculate the final price for the final invoice, it is guaranteed against change for any reason PROVIDED payment for the full amount of the invoice is received on or before the due date shown.

For Your Protection

We exercise all care and diligence in providing cost quotations; however, changes do occur beyond our control. It is our policy that if our final invoice price is 7% or more higher than the price quoted at time of booking, then the arrangements may be cancelled by the client. In this circumstance, we require written/fax notice of cancellation, which must be received within 10 days of the final invoice date. We will refund all monies received, with the exception of monies already paid to 3rd parties, when the client has been previously advised in writing that such funds are non-refundable once paid.

Comprehensive Travel Insurance

We require that all passengers be properly insured against the costs of trip cancellation, trip interruption and out of country medical expense. You may provide your own insurance or purchase a policy through us.

General Notice

Living standards and practices as well as standards and conditions with respect to the provision of utilities, sanitary services and the grading of accommodation that differ from North American standards may be encountered during your travel.

Carrier Responsibility:

Carriers are not to be held responsible for any act, omission or event during the time that passengers are not on board the carrier's equipment. The passenger contract in use by the carrier, when issued, shall be the sole contract between the purchaser of these arrangements and/or the passengers and the carriers.

Responsibility:

JB&A Custom Holidays, a division of The Travel Broker & Cruise Centre, (referred to hereafter as 'JB&ACH') and/or its agents make arrangements with suppliers who provide travel services such as airlines, hotels, motorcoaches, sightseeing, car rental or other active arrangements for you. Although we use our best efforts to choose and recommend reputable and reliable suppliers, such suppliers are independent parties beyond our direct control. Therefore JB&ACH and/or its agents cannot be held responsible for the acts or omissions of these suppliers. The travel services provided are supplied on the conditions imposed by these suppliers and their liabilities may, in turn, be limited by their tariffs, conditions of carriage and international conventions or agreements. Accordingly, JB&ACH and/or its agents do not bear responsibility for the acts and omissions of these suppliers and do not assume responsibility for any claims, losses, damages, costs or expenses arising out of personal injury, accident or death, loss, damage or delay of baggage, or other property or delay or loss of enjoyment resulting from any of the following:

  1. The act or omission of any party other than JB&ACH or its employees.
  2. Sickness, theft, labour dispute, mechanical breakdown, equipment failure, quarantine, government action, weather,  acts of God or any other action or causes beyond the direct control of JB&ACH.
  3. Non-performance or negligence or deficient performance by any supplier.
  4. Missed connections or any substitution of hotels or carrier equipment beyond our control, with or without notice, or for any additional expense occasioned thereby
  5. Written notice of any claim against JB&ACH must be received no later than thirty (30) days after the conclusion of arrangements made by JB&ACH.
  6. No agent, employee or representative of JB&ACHhas the authority to waive, modify or alter any of the provisions herein.
  7. JB&ACHreserves the right to decline any person as a member on any of our tours at any time.

JB&ACH regrets the hazards of travel for which it cannot assume responsibility and strongly recommends the purchase of appropriate personal insurance.
